Section 128 Check

The Section 128 check checks the list of names of individuals who have been barred from taking part in the management of any independent school, under the terms of a direction made by the Secretary of State for Education. Independent schools, academies, free schools and educational recruitment companies must carry out these checks.

Which of my employees can have a Section 128 Check?

Headteachers, all staff on the senior leadership team (including non-teaching), proprietors and teaching positions with departmental headship are all staff that are considered to be in management positions that can have a Section 128 check. Please note, there are no specific definitions for ‘departmental headship’. Inspectors should check that the school takes a reasonable approach in the context.

What if my employee is found to have a sanction as a result of the Section 128 Check?

If there is a match on the Section 128 list, APCS will contact you immediately. A person who is on the Section 128 list is unable to participate in any management of an independent school such as: a management position in an independent school, academy or free school as an employee; a trustee of an academy or free school trust; a governor or member of a proprietor body for an independent school; or a governor on any governing body in an independent school, academy or free school that retains or has been delegated any management responsibilities.

Is a Section 128 Check the same as a DBS check or a Childrens Barred List check?

The Section 128 check is not a full criminal record check, neither does it check the Childrens Barred List, it just checks whether or not an applicant is barred from taking part in the management of any independent school.

How much is a Section 128 Check?

A standard Section 128 check is £10 plus VAT and you will usually receive the result the same day if you order before 2.30pm Monday to Friday. For any orders received after 2.30pm, the results may be issued the next working day. As soon as the checks have been completed, you will receive your results certificate via email. If you order a Fast Track Section 128 Check, your order will be prioritised and you should receive the result within two hours! There is an additional cost of £2.50 plus VAT for this service.
