What is a Section 182 Check?
The Section 128 check came into force in September 2014. It checks the names of individuals who have been barred from taking part in the management of any independent school, under the terms of a direction made by the Secretary of State for Education. A person who is prohibited is unable to participate in any management of an independent school such as: a management position in an independent school, academy or free school as an employee; a trustee of an academy or free school trust; a governor or member of a proprietor body for an independent school; or a governor on any governing body in an independent school, academy or free school that retains or has been delegated any management responsibilities.
Who can carry out a Section 128 Check?
The following organisations must carry out these checks:
- Independent Schools
- Academies and Free Schools
- Education Recruitment/Agency companies
Which members of staff require a Section 128 check?
The Section 128 check can be carried out on the following roles:
- In a management position in an independent school, academy or free school as an employee
- A trustee of an academy or free school trust
- A governor or member of a proprietor body for an independent school
- A governor on any governing body.
How much is a Section 182 Check and when will I receive it?
A Section 128 check is £12 (including VAT) and you will receive the result the same day if you order before 2.30pm Monday to Friday. For orders received after 2.30pm, the results will be issued the next working day. As soon as the checks have been completed, you will receive your results certificate via email.

There are two possible results to a Section 128 check:
1) “PASS – No further comments.”
